As part of its case, Marvel intentionally created characters in City of Heroes based on their own protected characters to justify their DMCA claim. Jan 25, 2005) ("Defendants argued that specific exhibits and corresponding portions of plaintiffs' second amended complaint should have been stricken as 'false and sham' because the allegedly infringing works depicted in the exhibits and referred to in the pleadings were created by plaintiffs themselves.
